The Supreme Court has fixed Monday, October 23, 2023, for hearing the appeal by the presidential candidate of the Peoples Democratic Party (PDP) Atiku Abubakar, on the election of President Bola Ahmed Tinubu of the All Progressive Congress (APC).
Atiku had approached the presidential election tribunal to nullify the February 25 election, in which the Independent National Electoral Commission (INEC) declared Tinubu of the winner.
However, the tribunal struck out the petition for lack of merit.
Not satisfied with the verdict, the former Vice President filed an appeal before the Supreme Court.
In a notice on Thursday, Supreme Court Registrar, Zainab Garba, announced that Atiku’s appeal had been listed for hearing on Monday.
“Take notice that the above appeal/motion will be listed for hearing before the Supreme Court of Nigeria sitting at Abuja on Monday, October 23, 2023.
“And further take notice that in accordance with Order 2 Rule 1(2) of the Supreme Court Rules 1985, as amended, this NOTICE is deemed sufficiently served on you if it is left at your address of service or sent by registered post and since the date of service by post is material, Section 26 of the Interpretation Act, 1964 shall apρly.”
Tinubu defeated 17 other candidates who took part in the election after polling a total of 8,794,726 votes, the highest of all the candidates, thus meeting the first constitutional requirement to be declared the winner.
He also scored over 25 per cent of the votes cast in 30 states, more than the 24 states constitutionally required.
